On Services Rendered By Law Office #19 “INTERLAWYER”
of Moscow Bar “PROTECTION”
To Legal Entities And Private Individuals,
Moscow

I. GENERAL PROVISIONS

1.1. The size of attorney honorarium to be paid by legal entities and private individuals for provided services shall be defined by Head of the Law Office (hereinafter: Head of Office) in accordance with the current instructions and approved by the client and attorney. For tasks of high level of complication and in case of the client’s particular choice of attorney the service fee shall be defined by Head of Office and agreed upon by the client and attorney, according to the rank of attorney, and shall exceed the tariffs approved by the current instructions. For tasks that are not stipulated by the current instructions the size of honorarium shall be defined by both parties.

1.2. Head of Office and the attorney, assigned with the task, bear full responsibility for correct definition of honorarium size. Honorariums may be paid to the office’s bank account or in cash. Head of Office takes control over proper use of the current instructions.

1.3. In remote regions fees shall be raised according to the current instructions or defined by Head of Office and agreed upon by the attorney and the client.

1.4. The agreement, which describes the nature and volume of the task assigned to the Office, the size of attorney honorarium and other expenses related to the given task, shall be accompanied by a registration card signed by Head of Office, the attorney and the client.

1.5. Part of honorarium, which equals to the actual volume of work done, may be paid as an advance to the attorney upon his/her request and upon the approval of Head of Office.

1.6. In case of client’s refusal of attorney’s services the honorarium paid is kept by the Office. If the attorney is found guilty in failing to accomplish the task or in raising a conflict between the attorney and the client, the honorarium is subject to return except for the part that covers the work actually accomplished. If the task cannot be accomplished due to the reasons, which do not depend on the Office, the uncovered part of the honorarium may be returned to the client or transferred to the account of another attorney upon request. The amount of money subject to deduction or additional charge shall be defined by Head of Office and agreed upon by the attorney and the client. In case of revealing the attorney unconscientiously performing his/her professional duties, Head of Office, the Bar Presidium, the Chamber of Attorneys and the court shall have the right to deduct from the honorarium the amount of money, which will be returned to the client.

1.7. Upon request of the client the task may be assigned to two or more attorneys, irrespective of the degree of its complication. The cost of attorney services in the current instructions is defined in Euro (see Item 2, Article 317 of Civil Code of the Russian Federation). The payment shall be made in Roubles based on the Central Bank exchange rate as of the payment day. Value added tax (VAT) is not imposed on legal assistance services and is not included.

II. LEGAL SUPPORT FOR PRIVILEGED CITIZENS

2.1. Discounts on legal assistance services shall be provided in cases set forth by the current legislation of the Russian Federation.

2.2. Depending on the social status of the client, Head of Office shall have the right to free the client from the payment burden or to offer an adequate discount.

III. TARIFFS

A) Verbal or written consultation

3.1. Fifteen minutes for legal entities - from 25 to 50 Euro,

3.2. One hour for legal entities -  from 100 to 200 Euro,

3.3. Fifteen minutes for private individuals - from 15 to 30 Euro,

3.4. One hour for private individuals - from 60 to 120 Euro.

B) Long-term legal assistance for legal entities and private individuals

The legal assistance agreement is a legal, long-term civil agreement-assignment signed between the client and the attorney for a specified or unspecified term, which empowers the attorney to represent interests of his/her client and members of the client’s family in all government entities and other organizations of the Russian Federation

3.5. Long-term legal assistance for legal entities - from 5000 to 10 000 Euro;

3.6. Long-term legal assistance for private individuals - from 3000 to 5000 Euro.

The civil law agreement covers all areas of legal assistance including all types of counseling, composing applications, appeals, instructions, orders and other legal documents to be presented in court on civil, criminal, arbitration, and other cases, legal document search, etc., except for representing client’s interests in the court of general jurisdiction, in arbitration courts and government institutions and engaging in preliminary procedures as a defender.

C) Civil, arbitration and administrative cases

3.7. Entry to the case - from 2000 to 5000 Euro for legal entities,

3.8. Entry to the case - from 1000 to 2000 Euro for private individuals,

3.9. Representation in the court, government institutions and other organizations for legal entities – from 3000 to 10 000 Euro,

3.10. Representation in the court, government institutions and other organizations for private individuals – from 2000 to 5000 Euro.

D) Criminal cases

3.11. Entry to the case – from 2000 to 5000 Euro for legal entities,

3.12. Entry to the case – from 1000 to 3000 Euro for private individuals,

3.13. Representation in the court, government institutions and other organizations as a defender for legal entities – from 3000 to 10 000 Euro,

3.14. Representation in the court, government institutions and other organizations for private individuals – from 2000 to 8000 Euro,

3.15. One visit to investigative isolation cell (SIZO), temporary maintenance cell of solitary confinement (IVS) in Moscow – from 100 to 500 Euro, by-hour tariff may be considered as well.

E) Civil, arbitration, administrative and criminal property cases

3.16. Entry to the case - from 2000 to 10 000 Euro for legal entities,

3.17. Entry to the case - from 1000 to 5000 Euro for private individuals,

3.18. Representation in court, government institutions and other organizations for legal entities – from 10 % to 30% of claim in Euro,

3.19. Representation in the court, government institutions and other organizations for private individuals – from 5% to 20% of claim in Euro.

F) Additional holiday charges

3.20. Night time, holidays and weekends from 6 p.m. to 10 a.m. next day – from  200 to 500 Euro per hour for legal entities,

3.21. Night time, holidays and weekends from 6 p.m. to 10 a.m. next day – from 150 to 300 Euro per hour for private individuals.

G) Travel expenses

3.22. For criminal, civil, arbitration, administrative and other cases which require traveling, in excess of honorarium, the following expenses shall be charged and agreed upon by the parties:

· per diem (including departure and arrival day),

· taxi services to and from airport, railway station, river port, or bus station,

· depending on type of transportation: for train – one-way fee shall not exceed the cost of one compartment seat, for plain – ticket price shall not exceed the cost of economy class, for water transport – fee shall not exceed the cost of second class, for bus and taxi – fee shall not exceed current tariffs used,

· cost of medical insurance, ticket booking and delivery, hotel room reservation, 1-piece baggage fee,

· 1-bedroom accommodation expenses,

· phone calls and facsimile expenses.

NOTE: Advance payment shall be made no later than 6 days before departure. All travel expenses shall be reimbursed within 3 days after attorney’s arrival.

3.23. Travel expenses shall be paid by the client according to the following tariffs:

· Moscovskaya oblast – traveling allowance 25-50 Euro + per diem 25-50 Euro + medical insurance 50-100 Euro,

 

· Tulskaya, Leningradskaya, Novgorodskaya, Pskovskaya, Vladimirskaya, Smolenskaya oblasts - traveling allowance 50-100 Euro + per diem 50-100 Euro + medical insurance 100-150 Euro,

· Subjects of the Russian Federation - traveling allowance 100-200 Euro + per diem 150-200 Euro + medical insurance 100-150 Euro,

· Europe, the Americas, Asia - traveling allowance 200-300 Euro + per diem 250-350 Euro + medical insurance 200-300 Euro.
