Assistant Attorney
In real life situations attorneys cannot always cope
with the scope of work in case proceedings. Attorney’s job oftentimes
requires urgent fulfillment of logistics assignments, such as fetching
correspondence from government and other agencies, copying materials, getting
registered for a visit to the investigative isolation cell, etc.
Sometimes these assignments may take up plenty of time, thus influencing
attorney’s efficiency. In this connection Article 27 of Federal Law #63 “On
the Bar and bar activity in the Russian Federation” introduces an institution of assistant
attorneys. According to the law, candidates that are eligible for the
position of an assistant attorney must have higher legal education,
specialized secondary education or be a second- or third-year law
student.
The aim and objectives of the assistant attorney
is to assist the attorney in achieving his/her goals and performing
his/her duties. Since the assistant attorney is made acquainted with case
proceedings, he/she is obliged to keep advocate secrecy.
The law indicates that the job of the assistant attorney
is not for common people willing to work, but for those with appropriate
background and knowledge of the legal profession.

Internship
The position of an intern presents the next step
of the legal career ladder. The legal status of the intern is similar to
that of the assistant attorney. The only difference is that the intern is
considered as a direct candidate for the bar exam. The law prescribes that
the intern should apprentice himself with an established lawyer with at
least 5 years experience in the Bar. The intern must keep advocate secrecy
and is allowed to be engaged in law practice under the guidance of his
supervisor. The supervisor gives various assignments to the intern and controls
his/her work.
The intern helps the attorney draft claim applications,
appeals, petitions, requests and other documents. He/she may as well be put
in charge of a criminal case controlled by the supervisor. The intern
status is described by Article 28 of Federal Law #63 “On the Bar and bar
activity in the Russian Federation”, which also sets forth his/her rights
and obligations. According to the law, candidates that are eligible for the
intern position must have higher legal education, specialized secondary
education or be a fourth- or fifth-year law student.
The major goal of the intern is to get prepared
for the bar activity, engage in legal counseling, collect legislative
materials and keep track of recently enacted laws and regulations, be
present at court sessions and meetings, at interrogations of the accused
by permission of the attorney and investigator, participate in drafting
procedural documents, study cases and participate in case proceedings,
take an active part in the law office’s life, keep an intern diary, file
cases, write internship reports and prepare for the bar exam.
